Introduction: a new procedure for greater convenience

The full repayment of your mortgage loan is undoubtedly a milestone of great importance in the financial life of any person or family. However, it is important to understand that the extinction of the debt does not imply the automatic cancellation of the mortgage as a real security right, which remains registered in the Property Registry. This registration, which once served to ensure to the bank the fulfilment of its obligations, now becomes a registered encumbrance that limits the full disposal of the property. Until it is cancelled, you will encounter difficulties in selling the property, applying for a new loan secured by it, or carrying out any other act of disposal with complete freedom.

With the aim of modernising and streamlining this essential procedure, the Notarial profession, in collaboration with the main financial institutions, has implemented a telematic service that allows the borrower to cancel their mortgage in a simple manner, either by attending the Notary Office in person or by completing the process electronically, without the need to travel.

How does the new mortgage cancellation system work?

Until recently, cancelling a mortgage involved a series of slow and bureaucratic steps. The bank had to issue a paper certificate confirming zero outstanding debt, which the client often had to collect in person. Subsequently, an authorised representative of the financial institution had to travel to the Notary Office chosen by the client to sign the deed of cancellation. This process depended on the representative’s availability, schedule coordination and the physical delivery of documents, which could delay the signing for weeks or even months.

The new system establishes a direct, secure and digital communication channel between financial institutions and Notary Offices, allowing the entire mortgage cancellation process to be managed fully electronically, eliminating the need for physical documents and the need for a representative of the institution to attend the signing.

The result is a more efficient procedure, which drastically reduces timeframes and associated costs, while providing full transparency regarding the status of the process for both the client and the professionals involved.

Procedure for the client: steps to follow

The process for the borrower has been significantly simplified:

Once you have fully repaid the loan, the first step is to contact your financial institution and request two key actions:

– The issuance of the corresponding zero debt certificate. This document is conclusive proof that the financial obligation has been extinguished.

– The activation of the cancellation procedure on the notarial telematic platform.

At the time of requesting activation, you must inform your bank which Notary you wish to sign the deed before. The law protects your right to freely choose a Notary. In the case of our Notary Office in Barcelona, you may request that the assignment be made to the platform of Mr Francisco Javier Monedero Alcover or Mr Mario Romeo García. Your financial institution will link all documentation to our office through the system.

In the application, you may choose whether the signing takes place in person at our Notary Office or electronically through the Citizen Notarial Portal.

  • Option A: in-person signing at our Notary Office: If you prefer the traditional method, once the bank has uploaded the transaction to our platform, our team will contact you to arrange an appointment. On the agreed day, you will only need to come to our offices with your valid ID card. The signing is a quick and straightforward act, since all prior processing will already have been completed electronically.
  • Option B: electronic signing through the Citizen Notarial Portal: If you are looking for maximum convenience and wish to avoid travelling, you may opt for signing by videoconference. To do so, once you have completed the request with your bank, you must follow these steps:

    – Register on the Notarial Citizen's Portal (https://www.portalnotarial.es), if you have not already done so. This portal is the secure electronic headquarters of the Spanish Notariat.

    – Within the portal, access the section “Loans and policies” and select the option “Payment letter and cancellation of guarantees”.

    – Start your request by selecting Mr Francisco Javier Monedero Alcover or Mr Mario Romeo García as the authorising Notary.

    – For this procedure, it is essential that you have a valid electronic certificate and that you have verified your identity on the portal.

Once the transaction has been assigned, we will agree with you on the day and time that best suits you for the signing. On the agreed date, whether in person or by videoconference, we will proceed with the authorisation of the deed of cancellation. Immediately afterwards, we will electronically notify your bank of the signing without delay.

Once the deed has been signed, the final step is its registration in the Property Registry so that the cancellation has full effect against third parties. Our team can handle this procedure on your behalf, should you wish, to ensure that the process is completed quickly and correctly, culminating in the definitive release of your property.

La cancelación de hipoteca constituye un trámite esencial una vez finalizado el pago íntegro del préstamo hipotecario, ya que permite eliminar de forma definitiva la carga registral que continúa figurando sobre el inmueble en el Registro de la Propiedad. Aunque muchas personas consideran que al pagar la última cuota la hipoteca desaparece automáticamente, jurídicamente la cancelación de hipoteca requiere una actuación formal posterior. Para completar correctamente la cancelación de hipoteca es necesario que la entidad financiera emita el certificado de deuda cero, que se otorgue la correspondiente escritura pública de cancelación ante Notario y que posteriormente dicha escritura se inscriba en el Registro de la Propiedad.

Gracias a este sistema, la cancelación de hipoteca puede tramitarse de forma más rápida, con mayor control del proceso y con una reducción significativa de tiempos respecto al sistema tradicional. La posibilidad de realizar parte de la cancelación de hipoteca mediante canales telemáticos supone además una mejora importante en comodidad para el ciudadano.

La cancelación de hipoteca también resulta fundamental desde el punto de vista registral, porque hasta que no se practica la correspondiente inscripción, la carga hipotecaria continúa apareciendo en la información registral del inmueble. Esto significa que, aunque la deuda ya no exista, la finca sigue reflejando una hipoteca vigente a efectos registrales. Una correcta cancelación de hipoteca garantiza que la situación jurídica de la vivienda quede plenamente actualizada y que el propietario pueda disponer libremente del inmueble sin limitaciones.
