Yes, the Public Notary has the obligation to provide legal advice, interpret, and legally configure the wishes of all parties, especially those most in need of protection.

Individuals have the right to freely choose a Notary, with no limitations other than those established by law. The choice of Notary is usually based on criteria such as proximity, trust, personal recommendations, or the speed and efficiency of the service.

In most cases, it is necessary to schedule an appointment to ensure the availability of the Notary and avoid waiting times.

Granting a power of attorney allows another person (agent) to act on your behalf in various legal, commercial, or personal matters, which is useful in situations of absence or incapacity.

Simply go to the notary with your National Identity Document and explain how you want to distribute your assets. If the notary deems it necessary, they will ask you for the deed of your assets or for more information, then draft the will in writing and proceed to execute the public deed.

The Notary Public verifies the legality of the sale, the identity and legal capacity of the grantors, the property titles, and, where applicable, the powers provided; checks the property's registration and documentation status of the property being sold, requests the seller's certificate proving that they are up to date with community fees and the energy efficiency certificate (if applicable); verifies the means of payment; ensures that the interested parties agree to and understand the contract they are signing; provides them with legal and tax information; provides any legal advice they request; and electronically submits the deed to the Property Registry once signed. In many municipalities, they check electronically whether the seller is up to date with their property tax payments.

In short, the Public Notary guarantees that they have verified the seller's property titles and supporting documentation and that the seller is legally able to transfer ownership.

However, current regulations do not generally require them to check electricity, water, or garbage bills, among other things, nor do they guarantee that the property has any defects or the paint is defective, to name a few examples. The buyer must be concerned about the latter.
